Squire <br />Environmental Protection Specialist <br />Division of Minerals and Geology <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: Mid-Continent Quarry - Permit No. M-82-121 <br />Dear Mr. Squire: <br />Reference is made to your letter of July 23, 1996 <br />advising that you have determined that the current financial <br />warranty is inadequate to reclaim the operation and therefore <br />that you believe a.violation exists of applicable rules and the <br />statute; also, that a formal public hearing will be held during <br />the August 28-29, 1996 Board meeting for consideration of <br />possible violation. <br />You further suggested we provide you with any evidence <br />that we may have indicating that the violations do not exist or <br />have been corrected. <br />We believe that your determination that a violation may <br />exist is incorrect for the following reasons: <br />1.0 Sondinc~ Requirement. <br />1.1 We understand the bond amount established by the <br />DMG is $13,213. DMG holds $7,000 against this amount paid by the <br />Bankruptcy Trustee upon liquidation of the Carbondale Industrial <br />Park leaving a deficiency of $6,213. ("the deficiency") <br />1.2 The deficiency was secured by first lien on the <br />Rock Dust Plant property which was liquidated and the net <br />
