Box 1773 ) <br />Durango, Colorado 81302 ) <br />NOTICE AND <br />ORDER TO PAY <br />CIVIL PENALTY <br />To John Dillon and all other persons engaged in or owning or controlling the <br />Walker Pit mining operation located in Section 27, Township 36N, Range 9W of <br />the N.M.P. M., in La Plata County, Colorado. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado i4ined Land <br />Reclamation Board by C.R.S. 34-32-123, the Board hereby makes the following <br />findings of fact: <br />T. On March 25, 1987 the Board conducted a hearing and found Sandco, Inc. to <br />be conducting the mining operation described above without a permit as <br />required by C.R.S. 34-32-101 et seq. <br />2. On March 25, 1987 the Board issued Notice of Violation and Cease and <br />Desist Order No. M-87-018 to Sandco, Inc. <br />3. On May 27, 1987 the Board conducted a hearing in accordance with C,R.S. <br />24-4-101 et seq. to consider assessment of civil penalities against <br />Sandco, Inc. <br />4. The Mined Land Reclamation Division presented evidence at the Formal <br />Public Hearing on May 27, 1987, demonstrating that: <br />Sandco, Inc. has conducted a mining operation known as the Walker Pit <br />located in Section 27, T36N, R9W, N. M.P.M., La Plata County, Colorado; and <br />Sandco, Inc, has not obtained a permit for such mining operations as <br />required by C.R.S. Section 34-32-101 et seq. <br />
