Lony <br /> Divisiun Dveclor <br />Re: Extension of Abatement Time for Rimrock Mine (C-89-074) NOV C-95-015. <br />Pursuant to Rules 5.03.2(2)(e), the Division finds an extension of time for abatement for <br />Rimrock Mine NOV C-95-015 is necessary. The violation was issued for failure to provide <br />the Division with current ownership and control information. The Division had been <br />notified by a third party. This was confirmed by the Secretary of States Office that the <br />permittee, Rimrock Coal Company, had been dissolved as a business entity. This effectively <br />left the permit without a valid permittee. <br />The violation was issued to both the "dissolved" permittee and the operator, Landmark <br />Reclamation, Inc. The abatement required both parties to obtain written approval for <br />transfer of the permit to a valid "person" in accordance with the Colorado Regulations. <br />The operator has diligently found a party willing to accept transfer of the permit and has <br />submitted a complete application. All items required have been submitted. The problem <br />impairing the Division from approving the transfer is an OSM Applicant/Violator System <br />recommendation of "Deny". <br />This "Deny" recommendation stems from a link with the operator, Landmark Reclamation, <br />Inc. There is no block on the proposed permittee. The blocked link to Landmark <br />Reclamation is Mr. Richard Randall, CEO, who is linked to a company in Oklahoma called <br />Randall and Blake of Oklahoma. There are significant outstanding civil penalties on <br />Randall and Blake of Oklahoma stemming from 1982 Cease Orders. Mr. Randall sold his <br />interests in Randall and Blake of Oklahoma 45 days after the 1982 Cease Orders were <br />issued. <br />Mr. Randall is currently appealing this link with Oklahoma Department of Mines and claims <br />that at the time the cease orders were issued (October 1, 1982), he did not have control of <br />Randall and Blake of Oklahoma. I have been in contact with Oklahoma Department of <br />Mines, and they indicated that they have not scheduled a hearing yet. They project the <br />hearing may occur some time in October. The AVS block is pending the result of this <br />appeal. <br />
