Presents a Modification to the Approved Coal Unloading System

The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 116, Paragraph 4,
of the Colorado Revised Statutes, that on December 17, 2004, an application to revise coal mining openfions at the Hayden
Gulch Loadout was considered complete for the purposes of filing. The revision was submitted by Hayden Gulch Terminal,
Inc.. Alt review and comment periods as provided in the Act and the Regulations initiate from this date of filing.
The Hayden Gulch Loadout has submitted a revision to change there permit to allow for the hauling of coal to the Loadout and
tracking the coal to the Hayden Station. The revision would allow for a coal stockpile at 2.0 million tons and the construction
of new facilities. The operator is not requesting an increase in disturbed or permit area. This is a Loadout only facility and no
coal is mined at this site.
The Other coal mining operation is on land located approximately 2 miles Southeast of Hayden. The permit azea is further
described as follows:
Portions of: E1/2 Sec. 10, W]/2 Sec. 14, E12EI2 Sec. I5, NEl/4 Sec. 22, NWl/4NW1/4 Sec. 23, Township 6 North, Range
88 West of the 6th P.M.
The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Mount Hams.
The applicant is required to publish notice in a local newspaper that this application has been deemed complete. At the time of
publication of this notice, [he applicant is additionally required to place a copy of this application at the Routt County
Courthouse, P.O. Box 773598, Steamboat Springs, CO 80477, and at the Division office. For additional information or to
provide written comments, contact the Division of Minerals and Geology, Room 215, 1313 Sherman Street, Denver,
Colorado 80203, [phone]. In order for us to comply with regulatory time frames, we request that comments be
submitted within fifteen (15) days of this letter. If no commenu aze received by then, we will proceed on the assumption that
you have no concerns with, or objections to, the apphcant's proposal.
