<br /> <br />NOTICE OF VIOLATION CHRONOLOGY <br />DAKOLI05 CONSTRUCTION COMPANY <br />Dakolios Pit No. 1 <br />MLRD Permit No. M-84-036 <br />BACKGROUND INFORMATION: <br />I ~I~II~II~II~~ ~II <br />sss <br />The MLRD Permit for the Dakolios Pit No. 1 was issued on Apr'1 30, 1984. <br />The site is a 72- acre alluvial sand and gravel mine situate on the <br />south bank of the St. Vrain Creek, 20 miles east of Longmont, Colorado in <br />Weld County. <br />The original mining plan included excavating 25 feet in dept , <br />intercepting the water table at approximately 10 feet from t e surface, <br />and dewatering via an NPDES regulated discharge point. The eclamation <br />plan called for 11.5 acres to be disturbed per year, with sl pes being <br />regraded at 3:1 and topsoil being replaced within 30 to 60 d ys of <br />mining. The original phased reclamation bond was set at $17,550. <br />JUNE 28, 1990: The Board revoked this permit due to the oper~tor's <br />failure to pay an annual fee. <br />OCTOBER 28, 1990: After hearing testimony from the operator, th Board <br />reinstated this permit with the condition tha the $350 <br />fee be paid. The Board also instructed the D vision to <br />re-evaluate the operation for adequating bond ng. <br />OCTOBER 31, 1990: The $350 fee was paid. <br />NOVEMBER 14, 1990: The permit was reinstated <br />MARCH 1, 1991: The Division inspected the site and found thak the <br />previously-approved concurrent reclamation wa not <br />occurring, creating an underbonded situation t the site. <br />MARCH 27, 1991: The Board, upon recommendation of the Divisio ordered <br />Dakolios Construction Company to increase its financial <br />warranty from $17,550 to a new total of $152, 50. The <br />Board assessed a civil penalty for failure to comply with <br />the conditions of a permit in the amount of $ 04,775, <br />based upon 365 days of violation and a penalt rate of <br />$835 per day. <br />gaw <br />9534E <br />11/20/91 <br />
