Included with that letter were a proof of publication
for bond release, verification of reclamation seed mixtures, and detailed plans and costs for
the reconfiguration and reclamation of the area surrounding Pond 4. That letter also
contemplated further responses to issues surrounding Pits 5/6 and other azeas at the site
would be submitted upon completion. Enclosed with this letter you will find 4 copies of
those responses along with the necessary supporting documentation. The enclosed
information has been developed in close cooperation with you and your staff and therefore
we anticipate that it should be fully responsive to all outstanding issues.
As we noted in the October 16 letter, Rockcastle remains committed to completing
the remaining reclamation activities as soon as practicable upon receiving the requisite
approvals and an acceptable resolution of the pending bond release requests. Accordingly,
we would request that you review the enclosed information as soon as possible and that we
schedule a meeting to resolve any lingering issues and agree upon an approach to move
towards further bond releases and completion of the work. In order to expedite such a
resolution, please contact Mr. Jerry Nettleton with ACZ Inc. (303-879-6260) _directly to
discuss technical matters. I will be contacting you in the near future to discuss the status
and schedule a meeting as appropriate.
