An attendance list was passed around. Bryan Kohlenberg (UD&FCD) and Craig <br />Jacobson (ICON Engineering) mentioned that comments on the Meeting Minutes <br />from November 28'h had been sent out via email. Jeff Schwarz (Massey Semenoff <br />Schwarz & Bailey, P.C.) and Jessica Barbier requested that copies of the ll/28 <br />minutes be distributed to them again. <br />2. Jeff Schwarz added that the State of Colorado Division of Minerals and Geology's <br />Board tnet last Wednesday. Jeff mentioned that at this meeting, the Board <br />determined that the location of the Bull Seep was not the cause of the May 5, 2001 <br />breach of the South Platte River. The Company's (Lafarge) position will now be to <br />focus on revising the drainage plan in accordance with the orders from the October <br />hearing. The Company had received a time extension, January l 1, 2002, from the <br />board to submit the revised plan. <br />3. Jeff continued to add that John Hickman (Lafarge) has been in contact with George <br />McDonald of the Fulton Ditch Company and the Fulton Ditch Board appears [o be <br />amenable to [he reduction of the Bull Seep flows, upstream of the First Creek <br />confluence, to 50-cfs. <br />4. Jeff began to discuss the current layout of the revised drainage plan. He mentioned <br />that the Company proposes to install a pump irrigation system to feed dewatering <br />flows into the BuII Seep upstream of the First Creek confluence to help support the <br />trees in the area. The irrigation will continue in that area until the completion of the <br />mining operation (December 31, 2006) when the ponds are officially turned over to <br />Denver Water. At that time all of the ponds will be lined and the groundwater is <br />expected to return to historic levels. <br />5. Jeff continued to mention that a drop structure has been proposed at the confluence <br />between the Bull Seep and Bull Seep Slough. He added that the Company is <br />currently negotiating with Ken McIntosh (McIntosh Farms) regarding the details of <br />an easement on Ken's property. <br />6. Jeff mentioned that the Company's objective was to develop a drainage plan <br />addressing the current drainage conditions and that [he overflow spillway from <br />Reservoir B would be considered more under the revised Reclamation plan, not the <br />drainage plan proposed to be submitted to the DM&G Board on January 11th. <br />C:\WINDOWS\TEMP\I2-19 meeling.doc <br />
