The
purpose of this memo is to explain the 112 Reclamation Permit application
process, your rights as either a party or a non-pazty, and the jurisdiction of the
Mined Land Board: The Office and Board operate under the provision of the
Construction Materials Act (Act), if the application is for the extraction of
construction materials. We operate under the Hardrock Act (Act), if the
application is for the extraction of non-construction materials.
If an application fora 112 Reclamation permit for a Construction Materials or
Hardrock operation is approved by tl'ie Board or Gffice, the approved permit is for
the life of the mining operation (Life of Mine) since our permits have no expiration
date. Revocation and
forfeiture may occur due to an uncorrected violation of the Act, Rules and
Regulations, or the terms of the approved permit.
THE'ROLE OF THE MINED LAND RECLAMATION BOARD.(BOARD):
The Mined Land Reclamation Board (MLRB or Board) is aseven-member Board
that serves at the pleasure of the Governor. The Governor appoints five Board
members from nominations submitted by each of the various constituencies
