Pre-Hearing Conference fora 112 Construction Materials <br />Reclamation Permit Application: <br />Dear Mr. Williams: <br />The Colorado Division of Minerals and Geology (DMG) has received your objection to the United Companies <br />of Mesa County Amendment Ol application to their 112 Reclamation Permit application. Therefore, in <br />accordance with Rule 2.7.1 of the Construction Materials Rules and Regulations of the Colorado Mined Land <br />Reclamation Board {MLRB), aPre-Hearing Conference must be held within thirty (30) days after the close of <br />the public comment period. Since the public comment period closed on July 31,2002, the Pre-hearing <br />Conference must be held on or before August 30,2002. Please contact me so we can arrange a time and place <br />for this Conference. You can call me at (303) 866-4062. <br />The purpose of the Pre-Hearing Conference is to describe the Office's review process, to explain the rights and <br />responsibilities of parties, to discuss and resolve issues to the extent possible, to describe the Board Hearing <br />processes, [o determine the list of issues under the Board's jurisdiction and to simplify the list, and to determine <br />who has demonstrated standing to be a party to the Formal Boazd Hearing. <br />The staff will schedule this matter for a Formal Public Hearing before the Colorado Mined Land Reclamation <br />Boazd. It is anticipated that this Hearing will be held on September 18 or 19, 2002. You will be notified of a <br />more precise time when this item is scheduled. <br />Please review the enclosed informational memo, dated October 2, 2001, RE: Citizen Participation in the 112 <br />Reclamation Permit Application Process Revised October 19, 2001, and complete either of the last two pages, if <br />applicable, and return any completed forms to the DMG or bring them to the Pre-Hearing Conference. Also, <br />please note, as described in Rule 2.7.1(4) of the Construction Materials Rules and Regulations, that "Any party <br />that does not attend the Pre-hearing Conference forfeits their party stains and all associated rights and privileges, <br />unless such party provides a fully executed proxy authorization form to the Pre-hearing Conference Officer and <br />the parties' authorized representative is present.
