Fraser: <br />On June 25, 1992 the Mined Land Reclamation Board considered requests for <br />reconsideration of Notice of Violation No. M-92-021 from representatives of <br />both Gold Hill Ventures and Colina Oro Mo11no, Inc. The Board ruled that <br />these requests for reconsideration will only be considered if the remainder of <br />the civil penalty is submitted to the State Treasurer within 20 days of the <br />June 25, 1992 hearing. If the remainder of the civil penalty is received by <br />the State Treasurer by that date, the requests for reconsideration can be <br />heard by the Board at the August Board meetings. <br />After consulting with the Attorney General's office, the Division staff will <br />present a comprehensive recommendation concerning Notice of Violation M-92-021 <br />and Permit M-83-141 at the August Board meeting. <br />The Board further ruled that the cease and desist order on the property can be <br />lifted only after the following outstanding corrective actions are completed: <br />(1) A final technical revision is submitted and approved by the <br />Division which details the necessary permit boundary adjustments. <br />(2) The water pumping and utilization scheme as outlined in the permit <br />is fully implemented and functional. The Division will confirm <br />this by inspection. <br />(3) A bond recalculation is completed and any additional bond is posted <br />with the Division. <br />C4) Written statement lifting the Cease and Desist Order by the <br />Division is received by the co-permittees. <br />
