~~ • Attachment A <br />Special Lease Stipulations <br />1. Paleontology Mitigation <br />a. Before undertaking any activities that may disturb the surface <br />of the lease lands, the lessee shall contact the authorized <br />officer of ,the Bureau of Land Management to determine whether <br />it will be required of the lessee to conduct a paleontologic <br />appraisal of the mine plan area, exploration plan area .or <br />leasehold, that may be adversely affected by lease-related <br />activities. The paleontologic appraisal shall be conducted by <br />. - - ~a qualified- paleontologist, or other person, approved by the <br />. =authorized :offi cer of the surface-managing agency. This <br />paleontologic appraisal shall use the published literature and, <br />`- where appropriate, field appraisals to determine the surface <br />"' ~ - `l;"occurrence of fossils of scientific significance. A report of <br />~~ the appraisal and recommendations for protecting or salvaging <br />°`.~any surface fossils of significant scientific interest on the <br />:.leased lands~~so identified shall be submitted to the authorized <br />- officer of the surface-managing agency. The lessee shall, when <br />_ necessary, undertake the measures provided in the approved <br />,mining, reclamation, or exploration plan to collect or <br />otherwise -protect any surface fossils of scientific <br />significance. The lessee shall not knowingly disturb, alter, <br />destroy or take any surface fossils of scientific significance. <br />b. During operations of other activites related to the lease, the <br />lessee shall not knowingly disturb, alter, destroy, or take any <br />• large and conspicuous fossils of scientific interest that may <br />occur below the surface and shall, Consistent with economic and <br />safety considerations, protect such fossils in conformance with <br />the measures included in the approval of the mining and <br />reclamation plan. <br />YV.V { _ ~. .~.. .. ... . .. ~ - ..-. .. . <br />.. ... ..... ., ice... .~: ~. <br />' ~.~ .. - tr• 1 - <br />c. The lessee shall immediately bring any such large, conspicuous <br />fossils of scientific interest discovered in the subsurface to <br />the attention of the BLM office. The District Manager and <br />t `. appropriate Area Manager or their acting will be notified <br />immediately. ~ Such fossils, when discovered, may De moved and <br />operations may continue as long as the fossil or fossils would <br />' not be seriously damaged or destroyed. The District Specialist <br />shall evaluate or have evaluated such discoveries brought to <br />his/her attention, and, within five working days, shall notify <br />the lessee what action shall be taken with respect to such <br />. discoveries. <br />d. Aii fossils of significant scientific interest shall remain <br />under the jurisdiction of the United States. Copies of all <br />paleontologic resource data generated as a result of the lease <br />term requirements shall be provided to the District Specialist. <br /> <br /> <br />~.. <br />~. -.J i'- .. r.. <br /> <br />
