Lochheud <br /> Eaecwive Dveuor <br />RE: Earl and Becky Bennett, Bennett Gravel Pit, Permit No. M-79-166, Reason to Believe a Violation E.~Qdel B Long <br />Di <br />t <br />fl <br /> ivision <br />rec <br />or <br />Dear Mr. and Ms. Bennett: <br />On June l8, 1997 we conducted an inspection of [he Bennett Gravel Pit and found that mining and processing operations <br />had disturbed acreage outside the approved permit boundary. <br />We believe this is in violation of Section 34-32.5-I 16(40(1) or Section 34-32.5-109 of [he Colorado Land Reclamation Ac[ <br />for [he Extraction of Construction Materials 34-32.5-101 et.seq. (C.R.S. 1984 and 1994 SUPP.) and Permit No <br />M-77-166 Exhibit A (legal description) and Exhibit C (mine plan map).. <br />Therefore, we have found reason to believe a violation exists to Permit M-79-166 and the Law and have scheduled this <br />matter before the Mined Land Reclamation Board. <br />The Division of Minerals and Geology has placed you and your operation on the Mined Land Reclamation Board meeting <br />agenda For consideration of possible violation of the above mentioned statute. This meeting is scheduled for the <br />September 24-25, 1997 Board meeting, in Room 318 of 1313 Sherman St., Denver, Colorado, commencing at 9:00 a.m. <br />each day. Your matter will be heard as soon after commencement as possible. Please call this office on September 22, t997 <br />for the specific day. <br />A[ the meeting [he Board may issue a Cease and Desist Order For your operation at the above cited location per <br />Article 32.5 of Title 34, Section 123 (I ). <br />At the same formal public hearing the Board will consider possible civil penalties (if a violation is found). Civil penalties <br />are levied pursuant to Article 32.5 of Title 34, Section 123(2) and (3). <br />If you have any questions, please contact Steve S.
