MIBBlB~ ~ C~BOlp9Y <br />Dear Mr. Lewicki: <br />I am responding to your request dated October 8, 1996 for a <br />Department of the Army permit for the discharge of dredged and <br />fill material associated with the partial sediment pond removal <br />and re-establishment of Curtis Creek at the Rienau No. 2 Mine. <br />The project is located at Curtis Creek in Section 29, Township 2 <br />North, Range 93 West, Rio Blanco County, Colorado. <br />The Chief of Engineers has issued nationwide general permit <br />number 21 which authorizes the discharge of dredged or fill <br />material in waters of the United States for activities associated <br />with surface coal mining activities. Your project can be <br />constructed under this authority provided the work meets the <br />conditions listed on the enclosed information sheets and the <br />following conditions: <br />a. Before beginning any work, you must obtain the <br />appropriate approval from the State of Colorado, Division of <br />Minerals and Geology; <br />b. Prior to any change in your work plans, you must <br />re-initiate contact with this office for review and approval; and <br />c. Each September 30th, for a period of 3 years after <br />completion of the work, you will submit a written report to this <br />office describing the success of the project. Representative <br />photographs of the work shall also be included in this report. <br />If any aspects of the work are not succeeding, you will provide <br />your proposed remedial measures in the reports. You will also <br />provide this office with copies of any monitoring reports <br />required by the Division of Minerals and Geology. <br />This permit verification will be valid until January 21, <br />1997. You should contact this office if work will extend beyond <br />this date. <br />
