Important Definitions <br />• What is oil? From § 112.2 "oil means oil of any kind or in any form, including... petroleum, fuel <br />oil, sludge, synthetic oils, mineral oils, oil refuse, or oil mixed with wastes other than dredged <br />spoil." <br />What is a SPCC Plan? From § 112.2 an SPCC plan is: "the document required by § 112.3 that <br />details the equipment, workforce, procedures, and steps to prevent, control, and provide adequate <br />countermeasures to a dischazge." <br />What is a facility? From §112.2 "facility means any mobile or fixed onshore or offshore <br />building, structure, installation, equipment, pipe, or pipeline (other than a vessel or a public <br />vessel) used in oil well drilling operations, oil storage, oil gathering, oil processing, oil transfer, <br />oil distribution, and waste treatment, or in which oil is used.... The boundaries of a facility <br />depend on several site-specific factors, including, but not limited to, the ownership or operation <br />of buildings, structures, and equipment on the same site and the types of activity at the site." <br />What is a bulk storage container? From §112.2 "any container used to store oil. These <br />containers are used for purposes including, but not limited to, the storage of oil prior to use, <br />while being used, or prior to further distribution in commerce." From §112.1(d)(2)(ii) "only <br />containers of oil with a capacity of 55 gallons or greater are counted" toward the 1320-gallon <br />threshold. The threshold applies to storage capacity contained in operating equipment as well as <br />to storage capacity in containers (see page 47044 of the July 17, 2002 Federal Register). <br />• Does the Climax Mine Facility meet the requirements for a SPCC Plan? Yes. The new <br />regulations state that a facility must comply with the SPCC requirements if <br />1. The facility has an aggregate above ground storage capacity of 1320 gallons of oil, and <br />2.
