3.0 CERTIFICATIONS <br />C~ <br />C~ <br />Climax Mine <br />~~ <br />U <br />3.1 Management Commitment <br />Climax Molybdenum Company and Climax Mine (Climax) are committed to compliance with <br />the procedures outlined in this Spill Prevention Control and Countermeasures (SPCC) Plan. It is <br />the intent of management to asswe that spills are prevented; however, if spills do occur, Climax <br />will utilize all reasonable resowces under its control to prevent offsite contamination of the <br />waters of the State of Colorado. Climax has made significant progress in the construction of <br />containment structwes for materials onsite since 1995 and mine management will continue to <br />evaluate the effectiveness of these systems to determine if improvements aze needed. Due to the <br />change in miye plan which has returned Climax Mine to standby status, and the resulting <br />reduction in manpower, Climax has had to update various work plans. Climax intends to <br />progressively implement all facets of this SPCC/MCP. In recent years Climax Mine has <br />committed to a comprehensive sitewide pollution prevention program designed to prevent <br />incidents from occurring. By inference this SPCC/MCP is included in the Climax pollution <br />prevention plan effort. In summary, it is Climax' goal to effectively control and mitigate any <br />spills within the}~inesite so that contaminated external dischazges to water courses do not occur. <br />Signed: ~~G/Lr/~ ~~.e~/ Date: ~ ~ G9 <br />J~ManaQer, imax Mine <br />3.2 Engineer's Certification <br />Date: ~" Lr1 <br />I, Michael D. Ellis, P.E., hereby attest that I am familiar with the Climax Mine Facility and I also <br />understand the Rules and Regulations promulgated under 40 CFR Part 112 Oil Pollution <br />Prevention and how they apply. Furthermore, I personally visited the site during 2003 and 2004 <br />for the purposes of gathering information in order to prepaze this SPCC/MCP. The SPCC/MCP <br />has been prepared in accordance with good engineering practice, including considerations given <br />for applicab]e industry standazds as well as the requirements of 40 CFR Part 112. Procedwes for <br />inspecting and testing the tanks and containers have been established and aze herein incorporated. <br />Based on my professional engineering judgment, this SPCC/MCP is adequate for the Climax <br />Mine Facility. <br />Signed : ~ l~ ~ ~~ <br />Michael D.
