Tltc leak is <br />apparently Iho result of ongoing and continuing subsidence caused from Aasltt <br />Resource's coal mining operation. <br />Demand is hereby made that Basin Resoun:cs take immodlate measures in <br />conjunction with the coopcralion of the Tattrm's to rc~ air [Ida leak, artd return the <br />property to its pre-strbsidcnco condition. <br />"l'hc City of Trinidad fins not afforded us much !imc to repair tlto leak. If not <br />promptly repaired tltc City of Trinidad will tam ofT the wafer to otlr betas rendering it <br />itnposslblc for us to maintain our home and care for our livestock. <br />The instant plnblcm was addressed during the original cilirens complaint filed in <br />1993 and Ute civil trial. The "sink hole" was viewed by D~9G, OSM, attd Basitt during <br />the initial investigation. '11tis is an ongoing subsidence issue. <br />Mr. Henry Austin with OSM bccante aware of the ongoing damage attd during <br />Itis ittspcction of tllc pro)tcrty on Scplember 22, 2000. Mr. Ron Thompson with Basin <br />Resources, Inc. was made aware of Ote ongoing damage on Septwnhor 22, 2000. To dale <br />Basin Resources, lac. ]ras made no allempt to repair tlto damage created by tltoir mining <br />operntiona. <br />TI»s is our formal notice of complaint ogainst Aasin licsourccs, lttc. for <br />subsidence damage to our home and property. <br />
