Long <br />Division Director <br />I have reviewed your response letter to Robert G. Collins, Esq. of the State <br />of Montana's Natural Resource Damage Program. It is unfortunate that this <br />confusion had to occur. I realize none of the parties involved antficipated <br />this curve ball from Montana. I also appreciate Mr. Collins' concern. <br />I appreciate your efforts in accomplishing the requested modification. As I <br />expressed to you last week, i did not want our ~,aork to date to go fbr naught. <br />i continue to believe that the M.O.U. and Contract provide sufficient <br />fle(lul ii t~l t0 pro t2Ct file Di`/1 iiGn5' file Par t125' Bdtti2 ~'IO Unt37n <br />Resources', and the Contractor's interests. <br />it i; my understanding that you will complete the modification of the M.O.U. <br />• Please forward the approcriate number of originals upon its completion. <br />i will obtain Mike Long's signature, as representative of the Division. <br />I anticipate that RCG/Hagler, Bailly, Inc. will expeditiously examine, approve <br />and execute the moeified Contract documents. Please keep me informbd of any <br />exchange you have with Dr. Maest. As Soon as you confirm her verbal <br />acceptance of the modified Contract, Harry Posey will contact her t~J schedule <br />the first round of sampling. <br />As I mentioned over the telephone, I am concerned that Mr. Collins' <br />modification probably eliminates the possibility of using Dr. Maest to <br />im/estigate the cause of any sampling problems that might: be encourntered. <br />like you, I hope that this eventuality does not occur.
