Lnng <br />Western Regional Coordinating Center ow~s~nnD~r,.~,n, <br />Office of Surface Mining <br />1999 Broadway, Suite 3320 <br />Denver, Colorado 80202-5733 <br />RE: TDN #X-93-020-370-005 Violation 1 of 3 <br />Golden Eagle Mine, Basin Resources, Inc., Permit C-81-013 <br />Dear Mr. Seibel: <br />On February 23, 1995 we transmitted to OSM-AFO a copy of our <br />results from the Division's further investigations into possible <br />subsidence impacts to a residence owned by Jim and Ann Tatum, <br />located near Weston, Colorado. <br />Since that time we have reviewed four additional reports at the <br />request of Ms. Tatum and conducted two additional on-site <br />investigations at the Tatum residence with OSM experts. As you are <br />aware, the OSM - WSC participated in these investigations with the <br />Division. <br />All of our investigations confirm that the Tatum residence is not <br />within an area where mine subsidence related to the 1st North Main <br />of the Golden Eagle Mine is occurring or has occurred. In <br />addition, all of our investigations and observations of the Tatum <br />residence did not yield any evidence of mine subsidence impacts. <br />Attached is a copy of our most recent letter informing the Tatums <br />of our findings. <br />Also attached are the records of our on-site visits with Drs. Craft <br />and Kohli of OSM. <br />OSM-AFO has previously determined, on February 4, 1994, that <br />Colorado's response to this TDN was appropriate. That <br />determination was appealed to Mr. Ed Kay, Deputy Director of OSM by <br />Ms. Ann Tatum. I believe that these efforts further confirm that <br />the Division has responded to this TDN issue in an appropriate <br />manner. Please inform me of your decision to uphold this earlier <br />determination or to overturn. <br />~`~ <br />
