The <br />cartclusion of the IandsGde study was that the field evidence does not indicate a causal relationship between the <br />Edwards Mine portal wafer discharge and the subject landslide. The water study reveals that the Edwards Mine <br />portal wazcr discharge does not originate from the West Ells Mine fault related water which', comprises the <br />majority of the water in the NW Panels sealed sump. MCC does not represent that these studies address all issues <br />of the West Elk Mine of Bear No. 3 Mine slope stability or probable hydrologic consequences; however, these <br />studies clearly show that the allegations of Notice of Violation (NOV) No. CV-97-022 arc unfounded.
