Successor understandsthatthereclamationplan(the'Plan'~requiredbythepermitandbyapplicab]estate <br />laws andregulations hes not been completed and is willing to assume full responsibility for the completion ofthePhm. <br />V. AGREEMENTS <br />Permittee and Successor hereby agree, for their own benefit sad for the benefit of the State, such agreements to be <br />effective ipso facto upon the approval by the State ofthe transfer of the Permit fiomPennitteeto Successor, asfollows: <br />1. Successor has inspected the mining and reclamation operations to its entire satisfaction anti is fully aware of <br />the conditions thereof. Successor rmderstands and accepts all of the conditions of the Permit <br />2. Successor will complete thereclamationplan,andherebya~c~~mesliabilityfarcompletingsuchpbmastoall <br />areas heretofore disturbed; as well as to all areas hereafter disturbed. Successor will perform all ofthe obligations of <br />the Petmittee under the Permit which have not heretofore been performed by Permittee. <br />3. Successor hereby tenders to the State its attached Performance and Financial Warranties;, which are to be <br />substitutedfor the Performance andFinancial Warranties heretofore filedby the Pemuttee, effective upon the release <br />of the latter Warranties. <br />4. Successor represents to the State that, tothebestofitsknowledge,informationandbeliet;itisnotinviolatian <br />of any ofthe provisions of the Colorado Mined Landreclamation Actwithrespect m any other operationconductedby <br />it in the State of Colorado. <br />Permittee and Successor hereby request the State to consent to the assignment of the Permit, torecognize Successor as <br />Successor Operator under the Permit, and to accept the tendered substitute Performance andFinancial Warranties in <br />place of the Warranties presently on Sle with the State. <br />This farm has been approved by the Mused Land RecLuxation Board pursuant to sections 34-32-129, GRS, of the <br />Mined Land Reclamation Ad and 34-32.5-119, C.RS., ojUre Colorado Land Reclamation Adfor the Extraction of <br />Construt4ion Materials. Any alteration or mod fuatlon offhis form shall result in voiding any permit issued on the <br />aHered or modifiedform and subjedthe operator to eerie and desistorders and civilpenaCiesfor operating widiouta <br />permit pursuant to sections 34-32-123, C.RS., of L':e Mined Land $edamation Ad and 34-32.5-123, GRS., of the <br />Colorado Land Reclamation Ad jor the Exlradion ojConstrudion Materials. <br />
