<br />~~ Mr. Allen Weaver <br />- 2 - <br />March 10, 1992 <br />5) It has come to the Division's attention in the last two months that <br />culverts 39 and 40 and the northern-most extension of the refuse access <br />road ditch are also outside of the permit area. The primary solution to <br />this topic, as has been discussed, has been to run the permit boundary <br />from the east corner of the Pond 5 embankment outslope west to the <br />north-south permit boundary line. Cathy Begej talked with Dave Bucknam, <br />Supervisor of the Inactive Mines Program, and confirmed that there would <br />be no special considerations from permitting lands reclaimed by the IMP. <br />As long as EFCI does not disturb this reclaimed area, there will be no <br />subsequent reclamation obligations. Right-of-entry documentation will be <br />required. <br />6) Abatement 4 of N.O.V. 91-37 required documentation of bonding costs <br />associated with removal of Ponds 1,2,5 and loadout Ponds 1 and 2. The <br />submittal suggests that reclamation costs for these ponds are covered <br />under backfiiling and grading estimates found in Exhibit 20. Page <br />2.05.4-5 acknowledges that sediment pond removal will occur at some time <br />following the main reclamation activities at the site. The Division, <br />however, needs to specifically know how much material .is in each pond <br />embankment, as well as whether any material is required to be stockpiled <br />to fill the pond depressions to achieve A.O.C. Mobilization at a later <br />date must also be incorporated into the bonding calculations. <br />The Division deadline for a decision on this revision is April 23, 1992. <br />Please get the adequacy responses to the Division by April 13, 1992, to <br />provide adequate time for Division review. <br />Sincerely, <br />Catherine W.
