MORRIS: The regulation itself, as <br />4 Mr. Long noted earlier, is violated when an <br />5 operator either fails or refuses to remedy or <br />6 rehabilitate -- repair or rehabilitate a structure <br />7 or refuses to pay compensation either to purchase <br />8 the property or pay a court-determined diminution <br />9 in value. <br />10 In the very unlikely event that Basin <br />11 didn't pay its judgment that the Tatums attained <br />12 this time they would have a right, in my view, to <br />13 come back and ask DMG to issue a notice of <br />14 violation. If Basin still refused to pay, that <br />15 notice of violation would ripen into a failure to <br />16 abate cessation order. There would be civil <br />17 penalties on top of the judgment associated with <br />18 Basin's continued refusal,to pay. <br />19 Eventually there would be a failure to <br />20 abate cessation order on the books that would <br />21 create a serious problem to Basin or any entity <br />22 that owned or controlled Basin in obtaining future <br />23 permits, not only in Colorado but in any state in <br />24 the United States. <br />25 Now, all of this is highly speculative. <br />
