75 <br />1 concerned about, and that's why when I made the <br />2 comment a little while ago about if the agency <br />3 wants to withdraw its notice of violation, I think <br />4 it needs to make some sort of a statement for the <br />5 record as to why it's doing it. <br />6 Otherwise it looks like we may not have <br />7 felt that there was a violation in the first place <br />8 when we filed the NOV, and there's something that's <br />9 not connecting right for me in this whole thing, <br />10 and to me it's beginning to look like it's a little <br />11 bit arbitrary on the part of the agency. <br />12 MR. JANOSEC: Dave. <br />13 MR. ABBOTT: The question I have is the <br />14 original NOV was filed based primarily on the <br />15 complaint from the Tatums. They withdrew their <br />16 complaint. So there is no complaint, so there's no <br />17 reason for an NOV. <br />18 MR. BERRY: That is our position. <br />19 MR. BROWN: Yes, Mr. Abbott, thank you. <br />20 That is our position that we have no basis to go <br />21 forward at this point. If, in fact, there was an <br />22 environmental issue, if there was a public safety <br />23 and health issue we would pursue this, we would <br />24 pursue this even if the citizen asked us to <br />25 withdraw. <br />
