73 <br />1 difficult position. We had an NOV issued to an <br />2 operator based entirely on a citizen's complaint <br />3 and a citizen's former court action. The citizen <br />4 has now said we don't want to pursue this before <br />5 the board. We believe we would rather go to court <br />6 which we're authorized to do under the statute. <br />7 And because the citizen has withdrawn <br />8 his complaint and asked us to withdraw the NOV, we <br />9 believe there's no reason to go forward, and as <br />10 Mike alluded to earlier, this is a different <br />11 situation than we normally have. <br />12 There's a lot of different things about <br />13 this case, but the important thing to remember, we <br />14 believe, for the board is there's no allegation of <br />15 environmental damage. There's no water quality <br />16 issues here. There's no potential human health or <br />17 safety hazards here. <br />18 What we have essentially is a private <br />19 property damages dispute that the statute <br />20 authorizes the division to intervene in if the <br />21 citizen complains and wants to go forward. In this <br />22 instance the citizen initially decided they wanted <br />23 to do this and changed their mind and decided that <br />24 they'd rather go court, which they're authorized to <br />25 do. <br />
