73
1 difficult position. We had an NOV issued to an
2 operator based entirely on a citizen's complaint
3 and a citizen's former court action. The citizen
4 has now said we don't want to pursue this before
5 the board. We believe we would rather go to court
6 which we're authorized to do under the statute.
7 And because the citizen has withdrawn
8 his complaint and asked us to withdraw the NOV, we
9 believe there's no reason to go forward, and as
10 Mike alluded to earlier, this is a different
11 situation than we normally have.
12 There's a lot of different things about
13 this case, but the important thing to remember, we
14 believe, for the board is there's no allegation of
15 environmental damage. There's no water quality
16 issues here. There's no potential human health or
17 safety hazards here.
18 What we have essentially is a private
19 property damages dispute that the statute
20 authorizes the division to intervene in if the
21 citizen complains and wants to go forward. In this
22 instance the citizen initially decided they wanted
23 to do this and changed their mind and decided that
24 they'd rather go court, which they're authorized to
25 do.
