63 <br />1 Basically we asked to vacate the notice <br />2 of violation so we could cut to the chase and save <br />3 everybody time and effort. In doing so we handed <br />4 Basin a victory Mr. Anderson and his client want. <br />5 They don't have to pay a civil penalty. They don't <br />6 have a potential block against their violation <br />7 history. They won. <br />S It is -- in 25 years of practicing law <br />9 this is the first occasion on which I have had to <br />l0 come back into court and try to defend a decision <br />11 to let the other side off the hook. Now, it's true <br />12 they're not completely off the hook, but continuing <br />13 to go adjudicate this matter when Basin has <br />14 absolutely no standing to complain about what has <br />15 happened is not going to serve any useful purpose <br />16 for any of us. <br />17 So based upon that and upon the <br />18 arguments that I've made in writing and adopting <br />19 the arguments made by DMG in writing to this point <br />20 with respect to jurisdiction and the subjects we've <br />21 intervened on, we would ask the board to deny <br />22 Basin's motion for lack of jurisdiction. <br />23 MR.
