I certainly recognize this <br />4 is an unusual set of circumstances for an operator <br />5 to come in and say, Oh, please, don't vacate this <br />6 NOV. <br />7 But this is an unusual set of <br />8 circumstances, and we're certainly not arguing that <br />9 the division never has authority to vacate NOVS. <br />10 It's clear under the regulations that if they go <br />11 through the assessment conference process, they <br />12 have that authority. <br />13 What we're arguing is that under this <br />14 particular set of facts the division did not have <br />15 good cause to vacate this NOV and that Basin is <br />16 extremely prejudiced by the division's actions, and <br />17 we ask that the board review that action and <br />18 overturn it. <br />19 It's important to remember why we're <br />20 here. It's important to remember that this is a <br />21 result of a complaint that was brought by the <br />22 Tatums that resulted -- to OSM, resulted in a <br />23 10-day notice from OSM saying to the division, You <br />24 must respond. The division went out, conducted an <br />25 inspection, found that there was a violation and <br />
