35 <br />1 take it much further. I said I've got court <br />2 precedence here, I've got IBLA precedence here, and <br />3 I've got a citizen complaining and alleging certain <br />4 things. I think we take the action, and that's <br />5 what we did. We wrote an enforcement action <br />6 against Basin Resources at that time. <br />7 Again, our actions were based <br />B substantially on the statement of the complainant <br />9 in this case, Ms. Ann Tatum. <br />10 In November, specifically November 13, <br />11 Basin Resources formally requested that a board <br />12 hearing occur in this matter. They wanted to <br />13 appeal the NOV. In January an assessment <br />14 conference was held, frankly, at our urging. In <br />15 fairness, I would like to state that Basin <br />16 Resources came to the assessment conference at <br />17 our -- the staff's urging, and based on our <br />18 understanding, frankly, the board in the past that <br />19 in general folks like to see an assessment <br />20 conference prior to getting into a major battle <br />21 before the board. <br />22 So we recommended that that might be a <br />23 good action, and Basin did come to the assessment <br />24 conference. At that point Basin, as I recall it, <br />25 did argue that this violation should be vacated, <br />
