33 <br />1 asked the division to, in turn, vacate without <br />2 prejudice the violation. We did those things. <br />3 We subsequently withdrew the hearing <br />4 from consideration by this board because we felt <br />5 that we had vacated -- and still feel vacated the <br />6 violation properly. So our hope as the division <br />7 would be that this board would merely approve that <br />8 withdrawal and in some manner affirm the division's <br />9 authority to act as it did specifically to vacate <br />10 the violation. <br />11 And I suppose the result of that would <br />12 also be a denial of Basin's motion to challenge our <br />13 actions, but the lawyers will talk more <br />14 specifically about the procedures regarding the <br />15 motions and so on. I'm not trying to step on any <br />16 toes whatsoever. <br />17 By way of history, October 16 is when <br />18 this process started last fall. The Tatums filed a <br />19 citizen's complaint with Office of Surface Mining <br />20 actually alleging that the complaint that the Basin <br />21 Resources Golden Eagle Mine through subsidence -- <br />22 through ground subsidence had caused damage to both <br />23 the structure and to their property, specifically <br />24 to a water line, causing a substantial leak to a <br />25 water line. <br />
