15
1 that Mr. Morris is asking for a motion to allow
2 them to intervene either to argue or to present
3 their side of this and what is the board's
4 jurisdiction.
5 MR. HELD: Mr. Chairman?
6 MR. JANOSEC: Yes.
7 MR. HELD: I guess my suggestion to the
8 board would be to grant Mr. Morris's motion to
9 intervene for the limited purpose of objecting to
10 the board's jurisdiction to do what they're going
11 to do today. I think that's what he's getting at,
12 and the board can decide, then, on the arguments of
13 all the parties whether it has that jurisdiction
14 that Mr. Morris is challenging.
15 If it decides that it has that
16 jurisdiction, then it sounds as though Mr. Morris
17 would prefer not to participate any further in the
i8 proceeding. Is that correct, Mr. Morris?
19 MR. MORRIS: That is correct. With the
20 understanding that this is a separate proceeding
21 from the outside because if you grant my motion to
22 intervene, you are basically telling the Tatums
23 that they are not participating in a continuation
24 of the proceeding that DMG canceled earlier this
25 month.
