We're trying to keep the <br />2 train from going down one of those tracks at <br />3 least. <br />4 Apparently the Tatums only want to keep <br />5 this NOV around in case they get a judgment against <br />6 us and can't collect it. Unlikely. But most <br />7 people who go to court and get a judgment don't <br />8 have the ability to bring the power of the State of <br />9 Colorado administrative agencies down on the poor <br />10 guy who got the judgment against him to create more <br />11 leverage to force them to pay. <br />12 There are plenty of remedial actions <br />13 available to anybody who gets a judgment in court <br />14 to get their judgment collected, and certainly <br />15 there's no justification to keep this NOV live <br />16 simply to give the Tatums a big sledgehammer down <br />17 the road in case we don't pony up if they get a <br />18 }udgment against us in state court. <br />19 For that reason given that they don't <br />20 propound to have any other reason to keep the NOV <br />21 around, I propose the NOV, if it be vacated, it be <br />22 vacated with prejudice.
