102 <br />1 extent technologically and economically feasible, <br />2 maximize mine stability and maintain the value and <br />3 reasonably foreseeable use of such surface lands <br />4 except in those instances where the mining <br />5 technology used requires planned subsidence in a <br />6 predictable and controlled manner." <br />7 So the statute has what I would admit or <br />8 agree essentially is a performance standard for <br />9 underground coal mining not causing subsidence <br />10 damage to the surface. <br />11 Rule 4.20.1 of the coal rules states <br />12 under Rule 4.20, Subsidence Control. 4.20.1 <br />13 states, "General requirements. Underground mining <br />14 activities shall be planned and conducted so as to <br />15 prevent subsidence from causing material damage to <br />16 the surface to the extent technologically and <br />17 economically feasible so as to maintain the value <br />18 and reasonable foreseeable use of the surface <br />19 lands." <br />20 I guess the only question I would ask <br />21 the board and the division to resolve here is that <br />22 to me sounds like language requiring no damage to <br />23 the surface. I don't see anything in there that <br />24 suggests that that is completely and solely resting <br />25 whether there' s a continued citizen complaint. <br />
