This violation was written for failure
to maintain the primary containment structure for the stoker oil tank in
compliance with the Spill Prevention Control and Containment Plan. Energy
Fuels Coal Inc. had replaced the 7800 gallon tank with a 2500 gallon tank and
placed it in a steel containment vessel with dimensions 7.5' x 11' x 4'
(330 ft3). The stoker oil tank measures 7' in diameter x 7.9' in height
(304 ft3). The State of Colorado finds that primary containment of the
stoker oil tank is afforded by the steel containment vessel, and therefore no
violation exists at the site.
The inspection-report is enclosed for your review.
Sincerely
j:
~.' ~ ~:
' _
4~-
Ste n G.
