Dear Mr. Martino;
On June 20, 1984, our Division notified you that the Fidelity and Deposit
Company of Maryland had given us notice of the cancellation of Surety No.
60 24 530 in the amount of $2,500.00, effective November 7, 1984. The
cancellation was accepted by the Division as of that date; therefore, you were
notified that substitute surety in the amount of $2,500.00 must have been
submitted by November 7, 1984, to avoid consideration by our Board of a
possible violation to your permit. To date, we have received no replacement
warranty package.
Therefore, this matter has been scheduled for the November 14, 1984, meeting
of the Mined Land Reclamation Board for consideration of whether or not there
is reason to believe a violation to permit number 80-246 has occurred due to
your company's failure to maintain proper financial warranty on this
operation. This matter will be scheduled at 9:00 a.m., or as soon thereafter
as it may be heard. The meeting is to be held in Room 110 of 1313 Sherman, in
Denver. Please call this office on November 13, 1984, to find out a more
exact time that this matter will be heard. I suggest that a representative of
your company plan to attend this meeting.
If the Board finds that there is reason to believe a violation to your permit
has occurred, the Board will schedule a formal public hearing for the
December 13-14, 1984, meeting to consider the actual violation. Finding of a
