<br />Section IV -Decision to Reguire Revisions <br />As a result of this midterm review, the Division will require revision(s) of the permit to <br />address the following concerns with the currently approved Carbon Junction Mine permit <br />application. <br />1. DMG Application Form, pages 3 and 4. Please update the acreage amount to <br />reflect current conditions showing the total permitted acreage, affected acreage, <br />and disturbed acreage. <br />2. Rule 2.03.4 Please update all sections to include the dates that each <br />Officer/Director assumed their respective positions. <br />3. Rule 2.03.10 Water Quality Control Division requires a Storm Water <br />Management Plan (SWMP) be submitted to them and a copy of the SWMP <br />should be sent to the Division as well. <br />4. Please submit to the Division a copy of the latest Final Approval Air Emissions <br />Permit pertaining to the coal mine. <br />5. Please provide the Division evidence that Well Permit Nos. 25629-F and 26846-F <br />are still valid. <br />6. Rule 2.04.7 Hydrology Description. <br />a) Ground Water. Since the issuance of this permit, OEI has collected data on <br />three new ground water monitoring stations. This information needs to be <br />analyzed and the results should be incorporated into this section of the permit. <br />b) Surface Water. Information concerning ephemeral flow of Carbon Junction <br />Canyon is inadequate. Rule 2.04.7(2)(b)(i) requires maximum, minimum, and <br />average flow for this stream. Additionally, on page 4-15, the permit states that <br />Carbon Junction Canyon is an ephemeral stream, (which it is), yet on page 5-12, <br />paragraph 2, the text states that "there are no fords or ephemeral streams". This <br />statement needs to be corrected. <br />7. Rule 2.05.6(3) Protection of the Hydrologic Balance. <br />a) This section of the permit needs to be revised as it is very weak with regard to <br />surface water given the present condition of the mine. Little to no discussion is <br />presented with regard to impacts to surface water quantity or quality, even though <br />the permit states 'The Carbon Junction Mine will impact the quality and quantity <br />of ground and surface waters" (p. 5-40). Areas of concern include the open pits <br />and exposed coal seams, the fill, the current blocking of Carbon Junction Canyon, <br />the acid mine drainage coming out of the springs at the lower pit, as well as the <br />projected future of the gravel pit and how it will affect the final slope <br />configuration of the drainages, and how the lack of contemporaneous reclamation <br />efforts has or will affect ground and surface waters. <br />Midterm Review -Chimney Rock Mine 3 October 1995 <br />
