RE: Post-Mining Land Use Change at the Trinidad Basin Mine

Dear Sir:
This letter is written to notify you of a proposed decision by the Colorado
Mined Land Reclamation Division (the Division) to approve a request to change
the post-mining land use from rangelandlwildlife to residential on the western
half of the Trinidad Basin Mine. The land subject to the proposed land use
change includes the west 1/2 of section 15 and the west 1/2 of section 22,
T31S, R65W of the 6th P.M. in Las Animas County, Colorado. More specifically
the areas involved include portions of lots 32, 33, 34, 35, 36, 38, 39 and 64
of the Del Agua Canyon Ranches.
This decision complies with the Colorado hlined Land Reclamation Board Rules
for Coal Mining. Specifically, the decision is based in part on Rule 4.16.3,
Alternative Land Use. Two sections of this rule which pertain directly to
this change include determinations by the Division that:
4.16.3(1) The proposed post-mining land use is compatible with adjacent
land use and, where applicable, with existing local, state or
federal land use policies and plans: any required approval,
including any necessary zoning or other changes required for
land by local, state or federal land management agencies,
shall be obtained and remain valid throughout the surface
coal mining operations.
4.16.3(3) The proposed use will not present actual or probable hazard
to public health or safety nor will it pose actual or
probable threat of water flow diminution or pollution
contrary to state or federal laws, rules or regulations.
