REC~;i~i'~M~ PROPOSED PUBLIC NOTICE ppR 2 7 2006 KERR COAL COMPANY - MARR MINE -TECHNICAL REVISION NO. 22 CHANGE OF POND F STATUS TO PERMANENT Diviswn of Minerals ana Geology Ken• Coat Company (Kerr) has filed an application with thA Colorado Division of Minerals and Geology (DMG) for revision of the eurerrt Mining and Reclamation Permit for the Merr Mine. The proposed revision is to maintain Pond F as a permanent pond for long-term use by wildlife and livestock Pond F is situated in the Suvi/4 of the NE'/. of Section 28 in Township 9 North Range 78 West on the south side of County Road 12E. The pond collects runoff in a small watershed that is tributary to Bush Draw, which is located 1,000 feat to the north. The embankment of Pond F lies adjacent to, but outside of the right-of-way of a portion of County Road 12E - -said portion of the road adjacent to the embankment is approximately 450 lineal feet in length and is located (the road portion) 1,440 feet west of the intersection of County Road 29A and County Road 12E; County Road 29A being the Mar Mine arrtrance road. A public hearing to determine whether interests of the public and/or landowners are protected may be requested by contacting the Division of Minerals & Geology at their address and vlrithin the timefreme as shown beWw. If requested, a public meeting may be held at the local Community Center in Walden, Colorado. Kerr is the owner, operator and pernittee under Permit No. C-80-008. Mining ceased in 1993 and rerJamation activities are neariy completed. Pond F is within the Mine permit boundary as listed below. The mine is situated on the Johnny Moore Mountain, Gould NW, Walden and Eagle Hill 7.5 minute USGS quadrangle maps. Mine Permit Area • Township 8 North, Range 78 West -Section 2 • Township 9 North, Range 78 West -Sections 22, 23, 25, 26, 27 and 35 The U.S. Department of the Interior, Bureau of Land Management (BLM) owns the surface surounding Pond F. The United States and Douglas Barnett own the remaining surface lands within the permit boundary.
