<br />reseeded, full financial and performance warranty' release cannot be approved until the vegetative <br />cover is well established. As a result, the Division will hold back at least the cost to reveaetate a <br />completed phase until final tnancial and performance warranty releases are granted plus the full <br />costs for the active phase. <br />The current disturbance is a good example of what.would likely be expected in a worst case <br />scenario. This would include the current active phase plus the entire revegetation cost for the <br />previous phase. The cost [o reclaim the active phase in worst case disturbance will include <br />backtill/sloping, top soiling, and revegetation. Since there is likely to be some overlap of <br />phases, 8 acres should be used for the active phase disturbance area. Using the current <br />disturbance as an example, sloping and or backfilling all slopes to 3H:1 V or Hatter would need to <br />occur prior to re-applying topsoil. Top soiling should be calculated using 6 inches as the re- <br />application depth. For 8 acres this will amount to approximately 6400 cubic yards. For the <br />revegetation portion, all prep work such as seed bed preparation, fertilizer, etc. should be <br />included along with mulching if necessary and noxious weed control costs until desirable <br />vegetation is established. Also, if woody plants are added to the final plan for the east slope. <br />these costs should be included in the appropriate phases. <br />Using these figures a total of l4 acres should be `bonded", including 8 acres of active <br />disturbance along with an additional 6 acres of "revegetation only" costs. This will be subject to <br />change if timely release requests are not submitted and approved as mining progresses. When <br />DIvIG receives the updated cost estimate, it will be reviewed and possibly re-calculated using <br />DMG's in house bonding program. Also, please remember to add 23.x% to the actual hard cost <br />for completing the work. This amount is for contractor overhead and profit and DMG's <br />administrative cost if the financial warranty is ever forfeited and we are required to complete the <br />reclamation plan. <br />6.4.13 EXHIBIT M- Other Permits and Licenses <br />The issuance of a Reclamation Permit does not relieve the applicant of their responsibility for <br />obtaining or maintaining other required permits as necessary to conduct mining operations. <br />Attached to this letter are any comments that our office has received from other commenting <br />agencies that we normally contact to review the proposed activity, however, it is the operator's <br />responsibility to obtain clearance from those agencies listed under this exhibit. <br />6.4.14 EXHIBIT N-Source of Leal Right to Enter <br />See Exhibit O. <br />6.4.15 EXHIBIT O- Owner( of Record of Affected Land (Surface AreaZand Owners of <br />Substance to be Mined <br />
