IV. En torcement Actions <br />The tollowing identifies enforcement actions taken during this inspection, the <br />required abatement and date of abatement for the violation, previous violations <br />still requiring abatement and the termination of violations cited during previous <br />inspections. <br />NOV C-93-114 was issued for failure to submit proper permitting <br />documents for light-use roads on the mine site. There is a road <br />which fits the definition of a light-use road (1.04.111(c)) located <br />around the base of the refuse pile. Information required in Rule <br />4.03.3 was not submitted to the Division for approval prior to the <br />construction of this road. In addition, there are some upper roads <br />which were previously constructed Forest Service roads and <br />exploratory drilling roads which are now used by MCC to access <br />monitoring stations and the upper meadow. MCC's permit states <br />thatthey have neither constructed or maintained any light-use roads <br />on the mine site. Rule 2.05.3(3)(c) requires that the permit <br />contain a description of each road to be constructed, used, or <br />maintained within the permit area. The description should include <br />a map and appropriate cross-sections along with a number of other <br />specific requirements detailed in this regulation. In order to <br />abate the violation, the company is required to provide the proper <br />and adequate permitting documents pursuant to the two previously <br />reference rules for all light-use roads on the mine site. <br />NOTE: Attach appropriate VIOLATIONS OR CESSATION ORDER CODING FORMS <br />Revised: 4/88 <br />Doc.
