STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF: Costilla County ) NOTICE OF VIOLATION M-95-058 <br />P.O. Box 100 ) AND <br />San Luis, CO 81152 ) CEASE AND DESIST ORDER <br />TO: Costilla County and all other persons engaged in or owning or controlling the following <br />operation: Costilla Pit No. i, located at the location shown below. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land Reclamation Board by <br />C.R.S. 3432-124, the Board hereby makes the following findings of fact: <br />1. Costilla County is permitted to conduct a mining operation under the terms of Permit <br />M-77-044 located in Section 20, Township 25, Range 71W of the 6th P.M., in <br />Costilla County, Colorado. <br />2. The Mined Land Reclamation Board conducted a Formal Public Hearing on August 24, 1995 <br />to consider possible violation of the terms of Permit M-77-044 and C.R.S. 3432-101 et sea• <br />3. The Division of Minerals and Geology presented evidence at the Formal Public Hearing on <br />August 24, 1995, demonstrating that: <br />Costilla County was informed of certain corrective actions to be performed, as a <br />result of topsoil problems identified during a monitoring inspection. <br />Costilla County failed to perform the corrective actions in a timely manner, which <br />prompted this enforcement action by the Board. <br />NOTICE OF VIOLATION <br />Based upon these same Findings of Fact and in accordance with C.R.S. 3432-124(6), the Colorado <br />Mined Land Reclamation Board hereby finds Costilla County to be in violation of Permit M-77-044, <br />and C.R.S. 3432-116(7)(f). <br />
