Banta. <br />Division Director <br />The Colorado Mined Land Reclamation Board will hold an adjudicatory hearing <br />on the Division's proposed decision to release bond at Canadian Strip Mine <br />during the Board meeting on November 13 and 14, 1991. The operator, Wyoming <br />Fuels, is contesting the Division's interpretation of the regulations in <br />accordance with Rule 3.03.2(6). Specifically, the company is concerned that <br />the Division's decision was based on a guideline requiring the vegetative <br />cover to be 907, of the reference area with 90`r statistical accuracy. A copy <br />of the public notice associated with the Division's decision is enclosed for <br />your review. <br />The hearing had been scheduled for October but was continued until November <br />at Wyoming Fuels' request.
