The operator, Wyoming
Fuels, is contesting the Division's interpretation of the regulations in
accordance with Rule 3.03.2(6). Specifically, the company is concerned that
the Division's decision was based on a guideline requiring the vegetative
cover to be 90% of the reference area with 907, statistical accuracy. A copy
of the public notice associated with the Division's decision is enclosed for
your review.
The hearing had been scheduled for October but was continued until November
at Wyoming Fuels' request. Please call if you have any questions.
Sincerely,
f! ~_
. - /: `
Cath,eri e W Be ej~
Ree~amatton ecialist
CWB/eke
8434E
