The operator, Wyoming <br />Fuels, is contesting the Division's interpretation of the regulations in <br />accordance with Rule 3.03.2(6). Specifically, the company is concerned that <br />the Division's decision was based on a guideline requiring the vegetative <br />cover to be 907. of the reference area with 907. statistical accuracy. A copy <br />of the public notice associated with the Division's decision is enclosed for <br />your review. <br />The hearing had been scheduled for October but was continued until November <br />at Wyoming Fuels' request.
