Long <br />Divivon Dvecmr <br />NOV C-94-001 was issued for failure to maintain access road ditches <br />and prevent siltation. The NOV was issued on January 4, 1994 at <br />3:35 P.M. following a partial inspection and report at the site. <br />The Division received notice the following day that the NOV had <br />been abated, with a site inspection following on January 6, 1994. <br />The NOV was terminated at the site inspection on January 6, 1994. <br />History: Per Rule 5.04.5(3)(a) <br />The Keenesburg Mine has had no NOV's issued within the last 12 <br />months. The last NOV issued on the site occurred in March of 1990. <br />Seriousness: Per Rule 5.04.5(3)(6) <br />a) The duration of the violation lasted a few hours. The operator <br />had already begun actual ditch regrading and had instructed the <br />maintenance crew before the inspector left the site during the <br />inspection on January 4, 1994. The maintenance was completed by 2 <br />PM the next day, which included all the ditches on the site to be <br />regraded. <br />b) The probability of an occurrence of excess siltation and <br />breaching of the ditches was evident at one location where the <br />ditch had completely been silted in by sand slumping from the <br />topsand pile adjacent to the ditch (see photos taken). However, <br />due to the porosity of the sand on the site, surface water is <br />absorbed into the ground as supported by calculations in the <br />permit. Therefore, the probability of a precipitation event to <br />cause the ditch to be overtopped is low. <br />
