Mr. Terence Thom
3
State. A second letter was sent to the State on March 12, 1993, that elaborated on the
reasons for nonconcurrence. Throughout this time up to the present, further discussions
and meetings have occurred, including meetings between myself and the State officials.
You suggest that AFO and Colorado disagree on whether a bond can be released for
part of a permit area. This has never been an issue. Federal regulations specify that
partial bond release may be granted for a portion of the permit azea.
You have expressed concern that the permittee has been denied an administrative appeal
and due process regazding the decision of the Field Office Director. This is not the
case. A decision of Federal nonconcurrence in a bond release may be appealed in
accordance with the regulations found in 43 CFR Part 4.
Sincerely,
is/~~ ~~~
Allen D. Klein
Assistant Dtrector
Field Operations
Enclosure
cc: Michael B. Long, DMG
