<br />CEASE AND DESIST ORDER <br />AND CIVIL PENALTIES <br />Based upon these same Findings of Fac[ and Notice of Violation, and in accordance with C.R.S. 34-32-124 [he <br />Colorado Mined Land Reclamation Board hereby orders Adience, Inc. to: <br />Cease and desist from conducting any further mining activity outside the existing 9.9 acre permit area at <br />the Siloam Mine -Permit M-77-326, until such related disturbance has been included within an approved <br />permit area. <br />2. Mail, within one (I) day after receipt of this Notice, to the Mined Land Reclamation Board, written notice <br />of your compliance with pazagraph one (1) of this Cease and Desist Order. <br />3. Complete the following corrective action(s): <br />Replace the existing permit with a new 110(2) permit which includes the clay stockpile area outside the <br />current 9.9 acre permit area by July 24, 1997 OR secure a 1 12 permit by July 24, 1997 which includes <br />all acreage disturbed by Adience, Inc. <br />4. Pay the Colorado Mined Land Reclamation Board a civil penalty in the amount of $3,050.00, within 30 <br />days of the signature date of this document. This is based upon an assessment of $50.00 per day for <br />61 days of violation, from 12/27/96 to 2/26/97. <br />This Cease and Desist Order shall remain in effect until all terms have been satisfied by [he operator. <br />In clarification of the rights of recipients of Notices of Violation, Cease and Desist Orders, parties are advised [o <br />consult the Colorado Mined Land Reclamation Ac[ and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain acts to be performed within a certain time, <br />shall be construed as a permit or license to engage in any hard rock or metal mining operations within the State. <br />Persons concerned with judicial review of the provisions of this Order are advised to consult C.R.S. 24-4-106, as <br />amended. <br />Dated at Denver [his ,~Jnn ! / day of ri ~? . <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCE <br />ICHAEL B.
