<br />Ms Debra Campbell <br />July 18, 2006 <br />Page 4 <br />(e) Satisfactory proof that said ditch, diversion, or pipeline is engineered in such a <br />manner so as to utilize the minimum amount of private land. <br />The entire canal will be constructed on private land awned by the Climax Molybdenum <br />Company. The alignment of this canal was designed to maximize placement of the canal <br />on previously affected land. <br />(f) Satisfactory proof that said facilities shall not adversely affect fish populations, wildlife <br />habitat, or migratory ranges. <br />This is a replacement canal paralleling the existing interceptor canal. There is no impact <br />above and beyond the existing canal's affect on wildlife populations that are foreseen as <br />a result of this construction project. While there is continued contemplated expansion of <br />the tailing area that will inundate habitat, mitigation for wildlife considered by the <br />mitigation plan and future reclamation of the tailing area will offset near term impacts. <br />(g) Satisfactory proof that the facility will not adversely affect private'property owners in <br />the vicinity, and that appropriate studies have been conducted to show the impact of said <br />diversions, ditches, and pipelines upon the entirety of water users in Grand County. <br />The attached map (Attachment 8) shows the proximity of the ultimate canal to the <br />Henderson Mill property boundary. The outfall of this new canal will be made on <br />Henderson property in the same location as the existing canal. The impact to adjacent <br />property will be no more than the impact posed by the current canal. Adjacent <br />landowners were notified of the Amendment as required by the Hardrock Rules and <br />Regulations. <br />Attachment 8 also contains a statement concerning expected water depletions posed by <br />this project. <br />The County should be aware that Climax has received DMG acceptance of the canal design, and <br />has received Corps of Engineers approval of Climax's mitigation plan for the canal. <br />Please contact me with any questions or comments.
