<br />Permit Revision No. 03 (Eastern Mining District)
<br />Dear Assistant Supervisor:
<br />Pursuant to Title 34, Article 35, Paragraph 3, of the Colorado Revised
<br />Statutes, the Division of Minerals and Geology hereby issues notice that on
<br />July 16, 1993, an application to revise a current permit to conduct coal
<br />mining operations by Twentymile Coal Company, 29515 Routt County Road No. 27
<br />Oak Creek, Colorado 80467, was deemed complete for the purposes of filing.
<br />All reviews and comment periods as provided in the Act and Regulations
<br />promulgated thereunder initiate from this day of filing.
<br />The applicant proposes to revise underground coal mining operations at the
<br />Foidel Creek Mine. The permit revision would expand the current mine plan
<br />area into the Eastern Mining District and expand the permit boundary.

<br />The mine plan area is located in portions of Sections 13, 14, 21, 22, 23, 24,
<br />2b, 27, 28, and 33 in TSN, RBbW of the bth P.M. the expanded permit boundary
<br />is located in portions of Sections 10, 11, 12, 13, 14, 15, 16, 21, 22, 23, 24,
<br />26, 27, 28, and 33 in TSN, R86W of the 6th P.M., Routt County, Colorado. The
<br />above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle maps of
<br />Cow Creek, Milner, Oak Creek and Rattlesnake Butte.
<br />Because the above referenced permit revision application would incorporate
<br />additional lands into the permit area or might otherwise alter previously
<br />approved permit conditions or mitigation measures, we are requesting your
<br />agency's evaluation of the potential for impacts to threatened or endangered
<br />species of plants or animals, or wildlife species otherwise protected by
<br />federal law.
<br />In order for us to approve this revision, we are required to make a finding
<br />that "the activities would not affect the continued existence of endangered or
<br />threatened species or result in the destruction or adverse modification of
<br />their critical habitats as determined under the Endangered Species Act of
<br />]973..." We request your review and recommendation pursuant to this finding.
<br />Applicable sections of the revision application are enclosed. Please advise
<br />us if you require additional information.
