<br />-2- <br />CEASE AND DESIST ORDER <br />i <br />Based upon these same Findings of Fact and Notice of Violation, and in accordance with C.R.S. <br />34-32.5-124(2), (6) and (7) the Colorado Mined Land Reclamation Board hereby orders Fremont Paving <br />and Redi-Mix, Inc., to: <br />1. Cease and desist from conducting the following mining operations at the Florence Pit, Permit <br />M-95-0O8: Any mining related operations, except reclamation according to the approved plan, <br />in the area disturbed outside of [he approved permit boundaries until such area has been included <br />in an approved permit area. <br />2. Mail, within one (I) day after receipt of this Notice, to the Mined Land Reclamation Board, <br />written notice of your compliance with paragraph one (p of this Cease and Desist Order. <br />3. Complete the following corrective action: Fremont Paving and Redi-Mix, Inc. will certify that <br />it will reclaim areas dismrbed outside the permit area on City of Florence property providing, <br />it can get permission to do so. <br />4. Pay the Colorado Mined Land Reclamation Board a civil penalty in the amount of $1,400.00, <br />within 30 days of the signature date of this document. This is based upon an assessment of <br />$100.00 per day for 14 days of violation, from October 30, 1996 to November 13, 1996. <br />This Cease and Desist Order shall remain in effect until all terms have been satisfied by the operator. <br />In clarification of the rights of recipients of Notices of Violation, Cease and Desist Orders, parties are <br />advised to consult the Colorado Mined Land Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain acts to be performed within a <br />certain time, shall be construed as a permit or license to engage in any prospecting or mining operations <br />within the State. <br />Persons concerned with judicial review of the provisions of [his Order are advised to consult C.R.S. <br />24~-106, as amended. <br />~~ <br />Dated at Denver this~~ day of ~' ov 'C L <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPAR E F NATURAL RESOURCES <br />MICHAEL B.
