GCOIUyy <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Subject: Battle Mountain Resources, Inc.(BMRI)- San Luis <br />Technical Revision No.18, Partial Backfill of the West Pit <br />Dear Mr. Dillie: a _/~ <br />This letter is in response to your letter dated November 1, 1995 which <br />reviewed BMRI's response to the approval stipulations of TR-018. The <br />Division's comments on Stipulation Nos. 3 and 7 are acceptable and <br />Stipulation No. 7 was fully addressed with the approval of TR-16. The <br />Division found that BMRI's response to Stipulation No. 5 was not adequately <br />addressed. Stipulation No. 5 states: <br />BMRI WILL SUBMIT A RESPONSE TO THE DIVISION WITHIN 30 DAYS OF THE DATE OF <br />THIS CONDITIONAL APPROVAL ADDRESSING THE ISSUE OF SURFACE DRAINAGE LEAVING <br />THE WEST PIT AREA. WILL THE SURFACE FLOW FROM STORM EVENTS AND/OR SNOWMELT <br />BE DIRECTED TO THE RITO SEGO DRAINAGE? IF SO, WILL A CULVERT BE INSTALLED <br />UNDER THE COUNTY ROAD? ZF NOT, WHERE WILL THE FLOW GO? <br />rMRI's response was as follows: <br />Surface flow i rom storm events and/or snowmelt will not be directed to the Rifo Seco drainage. <br />A~ discussed in 'FR-0lb Fermit Modification: Nest Fit Fartinl Backfill, D.3.2.3 and E.2.1, the backfilled :u ea of <br />the pit will be graded at a nominal LO percent slope to drain to the south and southwest. Ccu[trol of erosion will <br />be accomplished in pa[i by the existing series of benches in the pit wall and selectively placed rockfill around the <br />Backfill/pit wall contact. Backfill placement will be conducted in a n+auner that produces a filial surfaa~ <br />capable of fret draining. Calculations were completed fora 100-yr and a 10-yr, 24 hour storm event.
