Long <br /> Divivon DrteOOr <br />Re: Recommended Approval, Amendment Application, Snowstorm Placer, M-83-084 <br />Dear Ms. Brumitt: <br />The Division completed the required technical review of the submitted amendment application, and <br />subsequent responses to adequacy concerns. The applicant, Snowstorm Sand & Gravel LLC, has <br />complied with the minimum requirements of the Construction Materials Act and/or Rules and <br />Regulations so, therefore, the Division is prepared to recommend agproval of the amendment application <br />to the Mined Land Reclamation Board at the November 18-19, 1998 Board Meeting with one (1) <br />stipulation; the operator must comply with applicable state Water Laws, or backfill the mined pit. A <br />sufficient bond will be required to backfill the mined pit in case of permit revocation and bond forfeiture. <br />If water rights issues are resolved, and the operator intends to leave a pond as part of the reclamation <br />plan, the Division will approve the plan since a pond is compatible with the post-mining land use. <br />A Pre-hearing conference will be scheduled at the Colorado Stale University Cooperative Extension <br />building at 880 Bogue street (County Fairgrounds), Fairplay Colorado on November 12, 1998 at 10:00 <br />AM. However, if all the objectors withdraw their objections, the conference will be cancelled. <br />The item will be presented to the Mined Land Reclamation Board at the November 18-19, 1998 meeting. <br />The pre-hearing conference officer, at the pre-hearing conference, shall cause to be proposed a draft <br />Board order which shall contain the information required pursuant to Rule 2.7.1(2); which draft Board <br />order shall be presented to the Board at the November 18-19, 1998 meeting. The Board will decide <br />whether to adopt the draft Board order at the November meeting.
